One area we review is the onboarding process. And some of the most common errors occur with the I9 form.
Form I-9 is used for verifying the identity and employment authorization of individuals hired for employment in the United States. All U.S. employers must ensure proper completion of Form I-9 for each individual they hire for employment in the United States. This includes citizens and noncitizens.
The employer and employee must both complete parts of the I9. A few areas we see the most problems are:
- The area that says “I attest under perjury of law, that I am (check one of the following), and
- Section 2 where you are confirming their proof of identification.
In addition, we often see employers breaking 2 important rules:
1. The employer cannot tell the employee which form of identification they should bring. We can’t tell you how many times we hear “just bring your driver’s license and social security card.”
2. The employer is affirming they have examined the form of identification. That means that a copy of that does NOT count. You must confirm the actual documentation.
